Informed Consent and Healthcare

In recent years, the practice of medicine has increasingly evolved to rely on electronic forms of communication. When providing telehealth services, physicians are required to obtain the informed consent of patients similar to what is often required at in-person visits. This report includes summaries of relevant laws, regulations and medical board policies covering informed consent laws for telehealth, remote patient (physiologic) monitoring (RPM), and the use of artificial intelligence.  

 

Forty-five states, the District of Columbia (DC), and Puerto Rico require physicians to obtain informed consent for telehealth services. Several states require consent from the patient before receiving services and include additional requirements for specialists and other medical-related professions.
